My BF and I have been having problems. I am currently living in one state and cannot afford to stay here if we cant work things out. I would most likely be going back to my home state, but he is threatening me with a custody battle. He is not a bad guy, and he loves our daughter, but we cannot be together.

Does anyone know what my rights are as far as leaving the state? Can he take her? I am so afraid of what might happen.... Sad

Has paternity been established? If it has if you get up and move you might have some problems. He has just the same rights as you do, in most states anyways.

If paternity was not established, then yes you can probably move BUT he can always file for paternity and visitation, and you will not be able to file anything in this new state until you have established residency, which is at least 6 months.
