I recently got divorced with joint custody. I have physical custody. I recently moved out of state with our kids because I was in danger with him around. In my divorce decree it says that I could with 60 days written notice to the father. He has been ordered to pay child support and he hasn't paid anything. I am to afraid to go after him for it. I just want the best for my kids. I ask them do they want to see him or stay with him they say no because he verbally and physically abuses them. They are too afraid. Despite his wrong doings I never talk down of him around them either. He has no address for residency though. In court he told the judge that he was living out of his car. Know he filed a motion trying to get full custody. Should I be worried of him getting full custody? I'm too afraid to return to the state. He has an endangerment felony that was pending against him with our oldest daughter. And he had a DCF case stating that he stay away from her. He has also been arrested for coming into my home after the divorce and not leaving. He had to get a police escort out. But he doesn't have anything against him with the last child. Should I be concerned about losing cusody?

If he has all that against him i would not worry too much unless he gets his act total around but if he has a sexual abuse charge against him then i doubt he will ever get his kids back as far as child support if you are being paid through the courts they will eventually rule him into court for not paying child support i know in south carolina when my ex was not paying child support i had to go up there every two weeks and let them know i was not getting it and they would send him a rule to show cause if he had been a few months and then we would go to court after about two rule to show cause and he did not show up i was advised by the courts to file for dss support because i did not know about his job or anything about where he was living and then they put two bench warrents on him he was finally picked up in 2004 and went to jail for three months because his boss finally bailed him out and now he has his wages garnished but it depends on how bad you want your child support whether or not you want to rock that boat. he is required to pay you child support especially if it is court ordered and if it is not through the courts i would keep track of when he is paying you and not so you have proof of the money you have not recieved and the money you have so if you go to court you can show the judge. i would not worry to much about him getting custody because he has to provide an address and phone number of where he is living and if he is living out of his car fat chance of that but dont let him know anything because chances are he will give a fake address and i would keep documentation of everything about him so you have a record but dont let your guard down stranger things have happened i know if he has endangered a child i dont think the courts would let him have custody i know last july i had to get supervised visitation for my ex because i finally got him on his drug use and that took me almost 3 years to do but he can not undo that until he takes me back to court and prooves to the courts that he went through treatement and is clean for a year good luck and keep us posted on whats going on and have faith that what i did i prayed and God steered me in the right direction and help me through the rough times and lean on freinds and family have a good week
