Ok I am 20 years old and I am 6 months pregnant. The father of my child and I lived together in an apt that I signed for for about 2 months and then I left and had the apt re-leased due to his verbal abuse and 1 time phys. abuse. I live in GA and have not been able to find any state laws on this. He is not happy about the split and is being spiteful. I am going to give the child my last name. when we split in April 06', I was 2 mo. pregnant and we have had no further contact. He doesn't have a place to live or a car and barely keeps $$ in his pocket. He cannot provide a stable life for this child and doesn't know how to care for an infant. Oh I am also in school to be a nurse, work for a childcare company and live with my mother right now.What can I do to get full custody and allow him supervised visitation? What are my rights as a mother?? help!!

Well I bilieve it is up to each state but here in Oklahoma if a child is born to an unwed mother she automatically has ALL rights and the father has NONE. If he wants any rights he has to go to court and win them or you have to give them to him.
Also you have every right to give the baby your last name. My son has my last name as his father showed very little if any involvement with him. Are you putting the father on the birth certificate? If so then he will be established as the father but in many states he has to sign an affidavit of paternity to be on it. That means he is admitting he is the father.
Personally if he has not even contacted you or shows any sort of concern for the baby then I would not notify him. I would give the baby my last name and leave the father part blank. If he ever gets his stuff together later and wants to be a dad then you can go from there.

well, if the dad is on the birth certificate he has some rights, but if you are unwed it is the mom that has full custody of the child...

the main way to have the father not have rights is to not put him on the birth certificate... but he can have that changed by taking you to court for visitation, and the courts will order a paternity test, and when the results come back if positive they will order the birth certificate changed to reflect the dad's name on it... also, if you take the baby's dad to court for support without putting the dad's name on the BC, the same will happen. and in the end his name will end up on the BC anyway... also it has happened that the dad can request the childs last name be changed to his... the courts have been known to do it more with boys then with girls for the whole carrying on the last name thing with men... since girls change their names to their husbands name in most cases of marriage the Judge may lean towards leaving the childs name as is... but if it is a boy to carry on the dad's last name they could and in alot of case do order the child's last name changed.
