My ex husband is a very manipulative person, uses our son as a pawn against me to try to get what he wants. I let my son go stay in Wisconsin briefly as I got a place in Virginia on the terms that my son was coming back. Every since then almost 2 years now the ex has been playing games in court, etc to keep my son from me. Now note I have a decent job for 8 years now with a good company, however, the divorce states I have primary placement of my son during the school year, but I have had a problem getting my son back ever since for almost 2 years now. My ex is claiming the guardian ad litem (child lawyer) wants her payment before she decides if my son can come for the summer, and the last ligation ended in he said she said, and no decision, still pending on placement since the ex tried to change the divorce due to "extradinary circumstances" which he neither proved because he lied and made it up and that's why it is still pending. How do I get my son back, I never did drugs, have a clean record, raised my son his whole life, do I have to pay the child lawyer before I see my son? My ex played all these shennanans for two years and I had to go up there to wisconsin and back just to fight in court and this has drained me financially.

Debbie

Contact an attorney in Wissconsin and ask for a consultation on the phone... as them if you can fax them the paperwork for them to look at and found out all your rights... if you are the child's primary guardian... then your ex is in contempt of court by not returning your child, and you should have filed contempt charges when he didn't return him.

The above post has nothing to do with contempt a decision is still pending in court, I have primary placement, the decision is pending the guardian ad litem's response back to the judge, my ex is saying the guardien adlitem wants payment before she gives decision, is this legal?

I don't think so... I am under the impression that if the courts appointed a guardian ad litem for the child, it is pro bono and no payment is required... if you hired someone to represent the child then you may have to pay them... or if he did he would have to pay them... but if there is payment due, then why is he only telling your ex and not you... I would contact the guardian ad litem yourself and ask if his response is being withheld due to lack of payment and who needs to pay him.
