You are going to be at fault with the courts since custody and support are two entirely different issues and one does not rely on the other.

If he is not paying court ordered support, then you should have taken him back to court for it to get it garnished from his wages etc. Usually joint (50/50) custody doesn't give either parent support money since each has to provide for half of the care.

But just cause he isn't paying doesn't mean he isn't allowed to see his children per the court order of custody time.

The courts are not going to look kindly on you. You need to allow him his time with his kids.

Unfortunitly, I have to totally agree with "Still in Love". You have to go after your support separely. Visitation and Custody will be awarded\judged in the courts from my experence.

To MaryM,

Do you think that maybe states should start enabling anyone to live in houses without paying mortgages or house taxes, after all ,what does that have to do with your rights to your home, but yet they enable any type of parent (criminal history meaning nothing) to force themselves back into a child's life without paying support and/or child day care? Mad Shocked
