I am going thru a pretty tough situation. I currently am married, have been married for 9 years. Through out the 9 years my husband has constantly cheated, lied, emotionally/mentally abused me and shame on me for taking it. I am now pregnant (4 1/2 months), separated, abandoned in our home in which he refuses to pay for, with my children trying to make it on my limited income. He has not offered to pay me, but has every intentions to go out and wine and dine other women. I was just recently diagnosed with depression...mostly due to this trauma. I have no support here where I live because it is his hometown not mine. I want to take the kids to a different county which is approx. 5 hours away so I can be with my support system and take care of myself, my kids, and my unborn baby. My intentions are not to take the kids from their father, ultimately they need him, my intentions are to take care of me, get thru this depression and enjoy my pregnancy. I am afraid of what the legal aspect is going to do...especially here in California. I don't want to be away for a long period of time, maybe about 1-2 months at the most. My doctor is going to put me on leave for about that duration of time and I want to take advantage of it in a more productive way. Any suggestions?

Contact an attorney there. California is sticky. My custody is based in california and if your soon to be ex wanted to be a prick he could say you up and took his kids. When I wanted to move home... and I moved 3000 miles from my son's father, I went to court and filed a move away petition.

Also, he needs to be paying you support. You really do need to go to court and get it ordered... even though you are not divorced yet, he doesn't get to not pay.

Depressed or not, you have things you need to do so you are going to have to suck it up... have your mom or someone come to stay with you if you need to.. and start by filing for custody and support and request a move away.
