...the father can still sue for custody and have physical custody until the trial date in the state the kid is currently living in.

I am going through the same thing. I did however, have a parenting agreement my ex and I put together, we signed and notarized it. But after he took her for the first summer visit (which happened before my daughter and I lived in my home state for six months) he kept her, filed suit and I have only been able to see her 3 times in the last 8 months.

Don't trust anyone!!!!!!!!
