My husband is very controlling. We have been married 3 years and together have a 7 month old son. He has custody of his 2 sons from a previous marriage, whom I am raising for him. I want out. We were going to therapy together but he stopped so I've been going on my own for a while now. He is verbally abusive, controlling, and is on medication for AADHD. I have been wanting to go to Michigan and visit my parents and sister but he won't allow me to take our son. He told me he'd call the police and have me arrested for kidnapping. Can he do this? As far as he knows there are no problems between us. I live in Florida, can anyone help me with an answer? I am so afraid of him and what I know he can and will do. I'm a registered nurse but am not working now because he thought I should stay home and raise the kids. I have no money of my own, only the joint accounts.

If you are married still, then you may need to talk to a lawyer there in florida. I don't know anything about florida laws but my opinion is that if he called the police and it is truly a vacation to see your parents and you are not trying to run... then the cops would likely tell him that.

If you are planning on running... maybe he realizes more then you think in the relationship. since the child was born in florida it is the child's state of residency... and you can not just take the child away.
