Hello,

The father of my kid always make his own schedule for pick up and drop off.

My order says : "Spring Break in all years from Friday evening or the Saturday after the close of school, depending on Father's travel arrangements, until the afternoon/evening on the Sunday before the start of school".

Father sent me an email last Monday says that he will do his pick up on Tuesday april 3rd at 1:30pm and drop off Monday 9th at 10:30am. My problem is , I am working during those time on those days. I told him that I could not do the drop up at that time but I could do it at 5pm instead, he still went and book a fly for 3:30 pm for Tuesday.

I cant do the drop off on that time because I work until 3pm. I schedule my work schedule and the rest of my life around that court order so there is not conflict with both side. But since he is not really following it, it makes hard on me.

My question is : If I don't drop my kid on Tueday at 2:45 pm,will it be a contempt to court order?

you can file a contempt order yourself since he is in contempt. technically no, you do not have to since the court her is pretty specific... but it could cause you some trouble... If I were you, I would call or check the airlines and see if there are later flights for your child to take... and re adjust your sons flights per court order... or highlight the court order and scan it into the computer and email it to him and let him know that do to your work schedule, you will be unable to comply with his schedule and you need him to follow the court order. and taht it would prbably be better if he spent spring break with you since he couldn't do it...

and then I would get your butt to court and correct the current order to something that is more fitting.

According to the law or court the process of visitation is totally different but if you have any doubt then I would like to tell that you contact Ms. Simon who is a family attorney and working in Florida since 2000 and is handling cases of divorce, custody, parenting plan etc.
