Hi there, my name is Donna. I am newly separated from my husband of 6 yrs and we have an amazing 5 1/2 yo little boy. When I say newly separated, I mean just today we decided it was best. While talking things over, we agreed to keep things civil. Our living situation is a lil different than most. We lived with his parents our entire marriage for financial reasons. Well, not wanting to argue with him, I agreed to have him live there with my husband & his parents, since I work 2nd shift. I would get to see our son whenever I wanted & also get him every other wknd. Now thinking more about this, I don't want to agree to it. I did tell him that I wanted him to live with me, but he did what he always did and talked me out of it. I am now living with my mother who is retired.
My question is what kind of rights do I have? I don't want to fight with my husband, but I need my son with me. [/quote]

go get him... when you have him next... or go over and pick him up... just take him with you... and then go directly to court and file for custody and support. if your mom is retired, then can't she watch him while you work. as long as no court papers have been filed, then no one has custody.
