Hi all... I'm 26 we live in TX I had my son about 18 months ago the father has seen him 2 times in 18 months, I managed to get him to take a DNA test which showed him as the father his name is not on the BC, I had a case the AOG but due to the time frame and the ex didn't show up due to military it got thrown out and the judge never even looked at the DNA results nor did custody or child support orders, what are my rights and does my sons dad have any legally yet, let me add that he hasn't been involved at all, I get e-mails from his wife, but none from him, he also left before the military was even a factor... The last time I talked to him was Last OCT when he told me if I needed help get on welfare, he is coming to Tx next week and his wife says he wasn't to see him, do I have to let him. again what are my rights and does he have any... PLEASE HELP

Is he not paying child support? You can get on welfare but if he isn't paying child support and you are getting aid from the govt the AG's office will nail him to the wall and make him pay everything back.

Your child's father hasn't established paternity in court or asked for his rights and until he does he doesn't really have any.

I'd call someone in the AG's(attorney General's) office that handles child support and get it done before I ask to go on welfare.
